Conditions of Travel
Train Trippin Tours &/or the associated tour operator/s reserve the right to alter the route or itinerary of any of its tours and arrange alternative carriers to those advertised if necessary. No refunds will be given in these circumstances, or in the event of any delay, curtailment or alteration of a trip resulting from any cause including severe weather conditions or mechanical failure. Train Trippin Tours can't guarantee pick-up or drop-off times and is not liable for passenger failure to connect with other services or any associated costs incurred. We accept no responsibility for loss/damage to personal belongings or baggage.
Liability
Whilst we make every effort to safeguard our clients and their belongings, we cannot be held responsible for personal injury or loss due to events which are beyond our control.
Important: Passengers should note that adventure travel involves a higher than normal risk and a signed release will be required from all participants before tour departure.
Travel Insurance
Travel insurance is NOT included, we strongly recommend that passengers have their own travel insurance against illness, injury, loss/damage to personal belongings and not being able to travel on the confirmed departure date.
Smoking & Drinking
Australian Government regulations prohibit smoking inside tourist vehicles in Australia. This includes travelling on the bus and train (smoking needs to be limited to planned stops along the route).
No alcohol is allowed to be brought on the coach at anytime during the tour. A limited amount of alcohol can be purchased along the train trip route and brought unopened onto the train. GLASS BOTTLES ARE PROHIBITED FROM BEING BROUGHT ONTO THE TRAIN. No More than 2 Cans Per Person are allowed on the train at any one time.
No alcohol is to be taken off the train between stops or vice versa.
Passenger Behaviour
No abusive or obscene behaviour will be tolerated to any member of the general public or other passengers.
No objects are to be thrown on or out of the train.
All passengers must keep all body parts inside the train at all times.
Any person who displays unacceptable behaviour such as the above will be removed from the bus or train and the police will be contacted if required. The person/s will then need to provide their own transport back to Sydney.
If a group as a whole is found to be displaying unacceptable behaviour the tour could be terminated (without a refund). This is for the safety & benefit of the passengers.
In the event the Company is forced to cancel a tour:
In the event the Company is forced to cancel a booking prior to commencement of the tour all customer payments will be fully refunded.
As is normally the case with group tours, a minimum number of bookings is required in order for a tour to be financially viable and to have a pleasant group atmosphere. In the event that adequate numbers cannot be achieved, it may be necessary to cancel a scheduled departure and to offer the nearest possible alternative date (or a full refund of monies paid). The date on which the decision is made whether a tour will operate is usually 14 days before the scheduled departure date. Once a tour has commenced there is no refund of fare or unused portion.
Disclaimer
Train Trippin Tours Pty Ltd (The Company) will take all reasonable steps to provide an enjoyable tour, but accepts no liability for any loss of enjoyment experienced by passengers.
The Company further accepts no liability for any loss beyond its reasonable control and provides no warranties in addition to those set out under the Trade Practices Act 1974, and nothing herein restricts any passenger from exercising their rights and remedies pursuant to law.
These tours include the services of operators other than The Company, which are not under the direct control of The Company, and whilst The Company takes all reasonable care in selecting these operators, it cannot accept responsibility for those operators' conduct or the conduct of their representative employees or agents or for any ramifications of that conduct.
These tours include activities such as the boarding and alighting from the train where there may not be a railway station platform available. Passengers accept that degrees of risk are involved.
No passenger will be permitted to embark or continue on tour if their mental or physical condition is, in the opinion of any representative of The Company, such as to render them incapable of caring for themselves; or whereby they act in an unsociable manner as to become objectionable to other passengers; or they become a hazard to themselves or other passengers; or engage in criminal acts. The Company will not be responsible for expenses resulting in such persons being precluded from completing the tour.
Itineraries described on the Company’s website and promotional material are subject to alteration without notice and intended as a guide only. Alterations may come about due to adverse road, rail or weather conditions, local flooding, strikes, public holidays, local festivals, or other reasons beyond the control of the Company. Examples of conditions that may impact the planned itinerary include NSW RailCorp or CountryLink timetable changes or a change in locomotive due to mechanical difficulties. The Company can give no guarantee as to the exact arrival and departure times of the tour and The Company will not be liable for failure to make connections with any other services or attractions. Any additional expense incurred by the passenger is not The Company's responsibility.
Passengers acknowledge that the company will provide its services only on the basis of each passenger's prior acceptance of this disclaimer as signified by their participation in the tour. This information, while correct at the time of publication, may be subject to change.
